HAY Community Guidelines

1.Introduction

At HAY, we aim to provide a fun platform for millions of users around the world to experience and develop meaningful connections without fear of rejection, judgment, and safety.

We are committed to giving users a safe and secure environment to connect with others and express themselves by protecting everyone’s privacy and safety. That said, we are aware that various misuse and abusive behaviors can occur in the social media world. Therefore, we implement these Community Guidelines to guide our users in understanding the rules and policies within our community. Our community guidelines define what is not allowed on the platform. They are set to encourage an open, authentic, and healthy discussion, which builds a safe environment where you can be yourself. Safety and trust are our number one priority. We implement strict AI technology and manual reviews to monitor, detect, analyze, and eliminate prohibited content during public display and matching on HAY. However, at the same time, your privacy during private sessions will be respected and protected. Users and accounts that violate our Terms of Service, Privacy Policy, and Community Guidelines are subject to a temporary or permanent suspension of the matching function or the entire functionality of the account, depending on the severity of the violation, at HAY’s discretion. However, if users believe their in-app functions or accounts are suspended by mistake, please contactsupport@hay.fun to appeal the mistaken suspension. Additionally, we encourage you to report inappropriate behavior or content (at support@hay.fun) you may come across so we can review it against our guidelines.

2.Minor Protection

2.1.Zero-tolerance policy: Minors are prohibited from using HAY. We implement strict AI technology and manual reviews to monitor, detect, analyze, and eliminate potential minors’ exposure on our Platform. Please do not use our Services if you are a minor, and please do not expose any minors on and to our Platform. Your account will be flagged and suspended if you violate our Terms of Service, Privacy Policy, and Community Guidelines.

According to relevant international regulation, Hay will not provide the Service in the following countries or territories:

• When a minor impersonates an adult or provides false information to HAY or other users as if they are an adult, or when an adult impersonates a minor or provides false information to HAY or other users as if they are a minor.

• Grooming behaviors are those in which an adult builds an emotional relationship with a minor in order to gain the minor's trust for the purposes of future or ongoing sexual contact, sexual abuse, trafficking, or other exploitation. 

• Pornographic images/videos of a minor or depictions of a minor.

• Content that directly, indirectly, or specifically describes minors as objects of a sexual nature.

• Acts such as showing minors participating in dangerous behavior or inciting and encouraging minors to engage in dangerous behavior (acts that may cause injury, including dangerous pranks).

• Acts such as encouraging, inciting, engaging, and assisting in cyberbullying or harassment involving minors (suggestive acts and sexual harassment, violent acts such as excessive insulting, targeting individuals to abuse or humiliate, exposing or requesting personal information such as phone numbers or bank account numbers, recording/photographing others without obtaining consent, disclosing, transmitting, sharing recordings, and agitating/bullying, etc.)

• We do not allow users who have been convicted of crimes against children to have an account on HAY. These crimes include sexual assault, molestation, murder, physical abuse or neglect, abduction, international parental kidnapping, trafficking, exploitation of minors for prostitution, live online sexual abuse of a minor, sexual exploitation of minors in the context of travel and tourism, attempts to obtain or distribute child sexual abuse materials, and the production, possession, or distribution of child sexual abuse materials.

• Not reporting to HAY and committing any of the acts below even though they recognize or are suspicious that the other party is a minor.

  • - Inducing or forcing a minor to pay or send a gift.
  • - Deceiving or threatening a minor to pay or send a gift.
  • -Permitting and encouraging a minor to send a payment or gift without reporting.

3.Adult-themed Content

3.1.Adult-themed Content

• Sexual explicit comments or slurs

• Content that explicitly or implicitly depicts sexual activities, including penetrative and non-penetrative sex, oral sex, or erotic kissing 

• Content that depicts sexual arousal or sexual stimulation

• Content that depicts a sexual fetish

• Content that depicts genitals, buttocks, the pubic region, or female nipples

• Content that contains sexually explicit language for sexual gratification

• Shirtless/underwear mirror selfies/videos: transparent clothing

• Nude images/videos of yourself or others, including visible genitalia, breasts

• Near nudity at HAY’s discretion

• Descriptions or depictions of masturbation, touching genitalia, sexual actions, or other sexual actions.

• The act of masturbation includes moaning or suggestive sexual actions.

• Displaying sexual images, pornographic videos, sex toys, underwear, etc.

• Sexually implicit behavior, such as continuously touching sensitive body parts.

• Content that simulates sexual activity with another person, either verbally, in the text (including emojis), or through the use of any in-app features

• Content that alters or morphs an image of another individual to portray or imply sexual suggestiveness or engagement in sexual activity

• Content that attempts to make unwanted sexual contact

• Content that disparages another person’s sexual activity

• Content dealing with sexual topics.

  • - Inappropriate references to genitalia, requesting sexual exposure, or sexual acts from other users.
  • - Uploading to one’s profile or sending sexual images, pornographic videos, adult toys, etc.
  • - Creating, sending, spreading, or sharing sexual content (including hidden cameras, deepfakes, photo editing, etc.).
  • - Including phrases, emoticons, or images that imply explicit, obscene content, such as sexual words, provocative and hateful sexual expressions, and slang or profanity about male and female genitalia, in the title of the livestream, user name, profile, etc.
  • - Proposing or demanding excessive physical exposure or sexual behavior in exchange for economic or non-economic compensation or requesting economic or non-economic compensation for providing excessive physical exposure or sexual behavior.

• Other obscene acts and sexual language do not fall under the above.

3.2.3.2.Digital sex crime:Distribution and exposure of illegal filming or pornography are prohibited.  In the case of severe issues, the HAY team shall discipline criminals and do our best to prevent a recurrence, cooperating with external agencies.

4.Violent, Hateful, and Inappropriate Content

4.1.Bullying, Harassment, and Hate Speech are strictly prohibited on HAY, and below is a non-exhausted list of such content:

• Content that insults another individual or disparages an individual on the basis of attributes such as intellect, appearance, personality traits, or hygiene

• Content that encourages coordinated harassment

• Content that disparages victims of violent tragedies

• Content that uses HAY interactive features (e.g., duet) to degrade others

• Content that depicts willful harm or intimidation, such as cyberstalking or trolling

• Content that wishes death, serious disease, or other serious harm on an individual

• Content that reveals, or threatens to reveal, details of a person's private sexual life, including digital content, sexual history, and names of previous sexual partners

• Content that exposes, or threatens to expose, a person's sexual orientation without their consent

• Content that threatens to reveal personal data or personally identifiable information (PII), including residential address, private email address, private phone number, bank statement, social security number, or passport number

• Content that threatens to blackmail an individual or hack an individual's account

• Content that incites or encourages others to hack or reveal another person's account, personal data, or personally identifiable information (PII)

• An individual's account, personal data, or personally identifiable information to encourage others to abuse, troll, or harass that individual

• Content that promotes or justifies violence, exclusion, segregation, or discrimination against them

• Content that promotes drug use or tools and means that facilitate drug use

4.2.Discrimination & Racism: HAY respects and embraces the diversity that all users bring to our Platform, therefore slurs or attacks against the following non-exhausted list is strictly prohibited: Race, Ethnicity, National Origin, Religion, Caste, Sexual orientation, Sex, Gender, Gender identity, Serious disease, Disability, Immigration status.

4.3.Unauthorized Advertisement: HAY is a social networking platform that provides users to make friends and connections across the globe. HAY does not purposefully or intentionally sponsor advertisements that lead to commercial gain. That said, any sponsorship or advertisement without HAY’s permission and consent is strictly prohibited on our Platform.

4.4.Suicide & Self-Harm are strictly prohibited on HAY, and below is a non-exhausted list of such content:

• Content that depicts promotes, normalizes, or glorifies suicide or self-harm

• Content that provides instructions for suicide or how to engage in self-harm

• Suicide or self-harm games, dares, challenges, pacts, or hoaxes

5.Copyright and Trademark Infringement

5.1.Copyright is a legal right that protects original works of authorship (e.g., music, videos) and original expression of an idea (e.g., the specific way a video or music is expressed or created), although it does not protect underlying ideas or facts. A trademark is a word, symbol, slogan, or design that identifies and distinguishes the source of a product or service. We encourage everyone to create and share original content. Content that infringes on someone else's intellectual property rights is prohibited on our platform and will be removed if we become aware of it. The use of copyrighted work under certain circumstances, such as the fair use doctrine or other applicable laws, or the use of a trademark to reference, lawfully comment, criticize, parody, make a fan page, or review a product or service, may not be considered a violation of our policies. Do not post, upload, stream, or share Content that violates or infringes someone else's copyrights, trademarks, or other intellectual property rights.

6.Anti-Fraud

6.1.Payment

6.1.1.It is illegal to use another person’s debit cards, credit cards, or any bank account information to purchase services. If you simply take another person's credit card and use it, you are committing credit card fraud. Even if a friend or family member gives you his or her card to use, you should not use it if your name is not on the card. A credit card is issued to the person who is authorized to make purchases. Therefore, please do not use a card that does not have your name on it.

6.1.2.HAY strictly prohibits users from purchasing or charging in-app virtual currencies through unauthorized third parties. All purchases shall be made through HAY or HAY’s authorized third parties.

6.1.3.If you purchase or charge HAY’s services and virtual currencies through unauthorized parties, your account will be permanently suspended without a refund from HAY. However, if users believe that their accounts are suspended by mistake, please contact support@hay.fun to appeal the mistaken suspension.

6.2.Refund: All sales are final, and HAY does not offer refunds, subject to rare exceptions, as HAY only provides digital online services and HAY’s services would immediately start once you’ve completed your purchase.

7.Privacy:

We do not allow content that violates the confidentiality of personal data or personally identifiable information (e.g., social security information, phone numbers, physical addresses). We remove content that depicts personal data or personally identifiable information (PII) from the Platform.Do not post, upload, stream, or share Content that contains personal data or personally identifiable information (PII). 

8.Account Authenticity:

We believe that trust forms the foundation of our community. We do not allow activities that may undermine the integrity of our platform or the authenticity of our users. We remove content or accounts that involve spam or fake engagement, impersonation, false affiliation with HAY, or misleading information that causes significant harm.

8.1.Account names that include the following elements are not allowed on HAY:

• Inappropriate, suggestive, or offensive words of any type

• Sexualizing or inappropriate emojis

• Contains HAY or any other terms that cause false affiliations with HAY
